Dublin, 5 October - Adjudication in Ireland - A debate on the proposed Construction Contracts Bill

NAWIC in association with Mason Hayes + Curran hosted a debate on the Irish Construction Contracts Bill 2010 which contains significant amendments to similar legislation in other jurisdictions such as the UK, Singapore and Australia.

Speakers from the UK Lindy Patterson QC and Finola O Farrell QC shared their experiences of adjudication in the UK and spoke about the new legislation which came into effect in the UK on 1 October 2011 to amend the existing legislation governing adjudication in the UK. Susan Bryson gave an overview of the draft legislation in Ireland highlighting the areas requiring amendment.

A lively disussion forum follwed in which participants raised concerns about the proposed Irish legislation. The issue receiving the most discussion was the fact that the provision in the Irish Bill providing that an Adjudicators decision will not be binding pending a referral to Arbitration.

NAWIC is against this provision and supports the position adopted by the Construction Industry Federation in this regard. Members are urged to write to local TD's in the terms of the following letter.
