Youth centre 'ruined' because infill used not fit for purpose

After 58 days in court, 52 of which were spent hearing expert evidence on pyrite heave, the commercial court has ruled that infill material supplied by Irish Asphalt to James Elliott Construction for the Ballymun Youth Centre was "not of merchantable quality" and therefore not fit for purpose. The court has ruled that IAL breached it's contract with JEC and damages for breach of contract will be decided at a later date.
